Xu kezhu:China's Erin Brockovich

Xu Kezhu could have been China’s Erin Brockovich. Since1999,  the  46-year-old  university professor has been helping pollution victims file lawsuits against companies and local governments in the hope of getting compensation and, more importantly, justice.
Ms Xu’s work is often difficult, involves painstaking investigation, and can be dangerous, as was the work of the woman made famous inthe film starring Julia Roberts.
Yet unlike the film, most of the time even Ms Xu’s strongest cases are rejected by the courts and her rare victories usually result in ap- peals that can drag on for years as the bankrupt defendants skip town.
In 2003, she helped some Tianjin residents file lawsuits against chemical factories whose emissions since the 1980s allegedly resulted in a higher cancer rate among the community. Tianjin courts refused to hear the case, Ms Xu said.
“They said we couldn’t prove the cause and effect but that should be something that is debated in trial,” she said. The environmental protection  departments eventually shut down most of the offenders.“But for the residents, there was no compensation. It wasn’t fair.”
Ms Xu is not one to give up easily. “I’m still quite optimistic.     Compared with just a few years ago, citizens now have a much greater sense of self-protection in these matters, and they are also demanding to be able to live in a good, clean and quiet environment.”
Ms Xu is deputy director of the China University of Political Science and Law’s Centre for Legal As- sistance to Pollution Victims, which was set up in late 1999. She teaches environmental law and said helping with actual cases was a natural ex- tension of her research and teaching. Although she has personally represented only five of the centre’s80-odd cases since it opened, Ms Xu has investigated many others.
Of all her cases, the ones involving air pollution were by far the most difficult.
“In Beijing, it is nearly impossible for a citizen to sue and get compensation for air pollution general- ly,” she said. With so many sources contributing to the pollution, there is no one to sue. Even if a major polluter could be pinpointed as the culprit, producing evidence to show that the  pollutants harmed the plaintiffs directly is difficult.
Yet her work is not always in vain. “By filing lawsuits, [the victims] may not get compensation, but it does put a lot of pressure on the local governments or companies to adhere to environmental laws and standards,” Ms Xu said.
In fact, often the most effective means of taking action was to file a written complaint to the state or lo- cal Environmental Protection Department, she said.
“But too many people are not even aware of which department they should go to.”
The centre was helping to spread information and educate the public on their rights and means to seek recourse through the courts. But, ultimately, Ms Xu believes knowing what to do lies not with the victims, but with the polluters.
“Companies should know and follow our environmental laws,” she said.
